Subject to the terms of this promotion and provided that customer undertakes and agrees to de-install and decommission its GC/MS system within 60 days upon installation of the new AB LC/MS/MS instrument at the customer's site, Applied Biosystems/MDS Analytical Technologies will provide customer a credit of $75,000 towards customer's purchase of a new API 2000, API 3200 or 3200 QTRAP LC/MS/MS System from Applied Biosystems/MDS Analytical Technologies. Such credit is non-transferable and not convertible to cash and cannot be used in combination with other discounts or promotions. The credit must be used within thirty (30) days from the date specified by Applied Biosystems/ MDS Analytical Technologies. Unused credit is forfeited after 30 days. This promotion applies only to the models on the list provided. Such GC/MS system must be from a recognized vendor (Applied Biosystems/MDS Analytical Technologies will have the sole discretion to determine if unit is from a recognized vendor). Customer must be the original owner of the GC/MS instrument and must have purchased the same as a brand new unit. Customer is responsible for paying all taxes (or in lieu thereof, you shall provide Applied Biosystems/MDS Analytical Technologies with a tax exemption certificate acceptable to the relevant taxing authorities), shipping and handling charges, freight, and insurance. Customer must not give or otherwise transfer the GC/MS instrument to any person. However, customer may use parts of your GC/MS instrument to replace parts of other GC/MS units that customer owns. If customer fails to de-install and decommission the GC/MS instrument within 60 days or breach any of the terms of this promotion, customer will pay Applied Biosystems/MDS Analytical Technologies $75,000 within thirty (30) days from receipt of an invoice for such amount.
